Policy Statement

The use and management of Berkeley Campus electronic communications resources must comply with the University of California Electronic Communications Policy (ECP) issued by the President of the University of California. In addition, the use and management of Berkeley Campus electronic communications resources must comply with campus-level regulations that supplement the terms and conditions of the ECP, including the Campus Online Activities Policy.

Who Is Affected by This Policy

The ECP and this Berkeley Campus Implementation apply to every member of the University community who either use, authorize access to, or provide, electronic communications resources and services of the Berkeley Campus. Electronic communications resources include:

Telecommunications equipment, transmission devices, electronic video and audio equipment, encoding or decoding equipment, computers and computer time, data processing or storage systems, computer systems, servers, networks, input/output and connecting devices, and related computer records, programs, software, and documentation that supports electronic communications services. (See ECP Appendix A: Definitions.)

Who Administers This Policy

Implementation of the ECP at the Berkeley Campus is the responsibility of the ECP Coordinator, in consultation with faculty, students, staff, and the UC Office of the President. Questions about the ECP or this Berkeley Campus Implementation may be directed to:

Why We Have This Policy

The ECP requires each separate UC campus to clarify some provisions of the ECP as they are are implemented locally, including:

… information on accessibility of student information, authorized users, procedures for restricting or denying use of its electronic communications services, adjudication of complaints, and network monitoring practices. (See ECP section II. D. 2 and 3, as well as ECP Attachment 2, Implementation Guidelines.)

Responsibilities

It is the responsibility of all members of the University community who either use, authorize access to, or provide, electronic communications resources and services of the Berkeley Campus to read and comply with the provisions of the ECP and this Implementation.

The Berkeley Campus-specific responsibilities that implement the ECP are included in, or referenced from, the E-Berkeley Policy for Campus Online Activities, which addresses:

The E-Berkeley policy applies to all electronic resources owned or managed by the Berkeley campus and all electronic resources provided by the campus through contracts and other agreements. For example, any website using the Berkeley.EDU domain is governed by the E-Berkeley Policy.

Glossary

Electronic Communications Service Provider: Any unit, organization, or staff with responsibility for managing the operation of and controlling individual user access to any part of the Berkeley Campus' electronic communications systems and services.

Berkeley Campus Electronic Communications Systems or Services: Electronic communications systems or services owned or operated by the Campus or any of its sub-units or provided through contracts with the Campus.

Use of Electronic Communications Services: To create, send, forward, reply to, transmit, distribute, broadcast, store, hold, copy, download, display, view, read, or print electronic communications with the aid of electronic communications services. An Electronic Communications User is an individual who makes use of electronic communications services.
